Voluntary Resettlement

The Project will be implemented in Bayankhoshuu and Sharkhad sub-centers under the voluntary land swapping mechanism.

The Government will ensure that the voluntary land swapping process is consistent with the approved urban land management plan of the Municipality of Ulaanbaatar, and will prevent any situation where affected households are subject to forced relocation, loss of residence, property, land plot, fences, or structures; or are deprived of the ability to continue living in the same location, to maintain livelihoods, businesses, employment, income, land use, or access to services.

The Government is responsible for the following:

Compensation is provided to affected households in accordance with the voluntary land swapping plans mutually agreed between ADB and the Municipality of Ulaanbaatar (MUB);

For target households without land ownership certificates and belonging to the lowest three deciles of household income distribution, the monthly cost of rental or rent-to-own apartments (including rent and utility fees) shall not exceed 25% of household monthly income;

Check

For households without land ownership certificates and falling above the fourth income decile, the monthly cost of rental, rent-to-own, or affordable housing units (including rent and utility fees) shall not exceed 30% of household monthly income;

Check

Implementation of livelihood restoration programs as agreed between ADB and MUB under the Voluntary Land Swapping Plans (VLSPs).

Involuntary Resettlement

In areas outside the eco-districts where infrastructure construction is required, involuntary resettlement may
be triggered. In accordance with ADB’s Safeguard Policy Statement (SPS 2009), the scope of resettlement
was updated and approved in 2021.
The Government is responsible for the following:

When involuntary land acquisition is unavoidable, a Land Acquisition and Resettlement Plan (LARP) shall be prepared based on the approved design and in line with the updated resettlement scope, and submitted to ADB for review and concurrence prior to commencement of land acquisition and resettlement activities;

Affected households will be fully informed and consulted at all stages of resettlement planning, updating, implementation, and monitoring;

Compensation required for land acquisition and resettlement shall be provided in accordance with the approved project budget and schedule;

The Project Management Office (PMO) and implementing agencies shall appoint designated officers responsible for updating, implementing, and monitoring the LARP, and shall submit semi-annual internal monitoring reports to ADB and MUB;

A grievance redress mechanism (GRM) shall be maintained to register, address, and resolve complaints and concerns raised by affected people and the public.
